Important
Notice to the subscribers
of the DVD-RW Format Specifications Book Ver.1.2
1. Scope.
This
important notice is provided for the DVD-RW Specifications Book
Ver.1.2 Subscribers engaged in manufacturing of DVD-RW discs (hereinafter
“Subscribers”). In this notice, DVD-RW Ver.1.2 disc
only refers to the DVD-RW Ver.1.2 disc which does not support
1x speed recording functionality (hereinafter “Ver.1.2 Disc”),
and does not refer to the DVD-RW Ver.1.2 disc which supports 1x
speed recording functionality.
2.
Background.
DVD
Specifications for Re-recordable Disc (DVD-RW) Part 1 PHYSICAL
SPECIFICATIONS Version 1.1 was upgraded to Ver.1.2 in November
2003. Ver.1.2 specifications provide 2-4x speed recording functionality.
Ver.1.2 Disc should only be used with Ver. 1.2 hardware. A Ver.1.2
Disc should NOT be used with Ver.1.0 or Ver.1.1 hardware. The
2-4x high-speed recording functionality can be performed ONLY
with a Ver.1.2 Disc and Ver.1.2 hardware. Any other hardware cannot
record any data onto a Ver.1.2 Disc, even if the hardware has
2x speed recording capability. When non-Ver.1.2 hardware tries
to record data onto Ver.1.2 Disc, the disc cannot be recognized
as usable media and will be ejected from the hardware. Moreover,
such improper use of a Ver.1.2 Disc with non-Ver.1.2 hardware
may result in damage to the data recorded on the Ver.1.2 Disc.
Therefore,
Subscribers may wish to provide an appropriate notice to end users
to avoid this potential problem. For this purpose, Subscribers
may wish to consider the following example of a warning notice
to end users.
3. Example of warning language.
As
an example, the DVD Forum provides the following sample warning
notice to be used for Ver.1.2 Disc products for the above-specified
purpose (hereinafter “the Sample Notice”).
"WARNING.
This disc is intended for use ONLY with recording hardware in
compliance with DVD-RW Specification Version 1.2. DO NOT USE THIS
DISC WITH ANY OTHER HARDWARE. Use of the disc with any other recording
hardware may result in ejection of the disc from the hardware
or DAMAGE to the data on the disc. Please consult the instruction
manual for your recording hardware to determine what version number
it is in compliance with."

The DVD Forum offers the foregoing Sample Notice only by way of
example for Subscribers’ consideration and individual judgment.
The DVD Forum does not require Subscribers to adopt the above
Sample Notice for any Subscribers’ DVD products. It is Subscribers’
sole discretion whether to use, modify or elect not to use the
Sample Notice.
5.
Subscribers are further advised that the physical characteristics
of any such notice with respect to DVD Products, such as placement,
type size and style, color, etc, shall be determined at the sole
discretion of Subscribers.

Subscribers may wish to consult their own legal counsel regarding
the use or non-use of any such notice with respect to their products.

SAMPLE NOTICE IS PROVIDED ONLY AS AN EXAMPLE. THE DVD FORUM MAKES
NO REPRESENTATIONS OR WARRANTIES, EXPRESS, IMPLIED, STATUTORY
OR OTHERWISE, AND EXPRESSLY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY EQUIVALENTS UNDER
THE LAWS OF ANY JURISDICTION, WITH RESPECT TO THE USE OR NON-USE
OF THE SAMPLE NOTICE OR OTHER NOTIFICATION, INCLUDING WITOUT LIMITATION

NEITHER THE DVD FORUM NOR ITS MEMBERS SHALL BE LIABLE TO SUBSCRIBERS
FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR
PUNITIVE DAMAGES ARISING OUT OF ANY CAUSE OF ACTION RELATING TO
USE OR NON-USE OF THESAMPLE NOTICE, OR BASED ON MAKING, USING,
SELLING OR DISTRIBUTING ANY DVD PRODUCTS WITH OR WITHOUT THE SAMPLE
NOTICE OR OTHER NOTIFICATION.
