Important Notice to the subscribers of the Optional Specifications Time Limited DVD-ROM Rev. 1.0

1. Scope.

This important notice is provided for the Optional Specifications Time Limited DVD-ROM Rev. 1.0 subscriber engaged in manufacturing Time Limited DVD-ROM discs, playback device manufacture, and/or content providers for Time Limited DVD-ROM discs (hereinafter “Subscribers”). In this notice, Time Limited DVD-ROM Rev. 1.0 Disc (hereinafter “Time Limited DVD-ROM”) refers to “DVD Specifications for Read-Only Disc (DVD-ROM) Part 1 (ver. 1.x) Optional Specifications Time Limited DVD-ROM Rev. 1.0”.

2. Background.

Time Limited DVD-ROM is a newly introduced type of disc to the DVD-ROM family. It is based on Dual Layer Read-Only Disc construction with a reactive material incorporated within the disc. The reactive material acts to reduce the playback signal until it can no longer be read by the playback device. In its initial state, the Time Limited DVD-ROM is similar to a standard DVD-ROM in that it meets all signal and physical specifications of the DVD-ROM specifications. After the protective packaging is opened, the Time Limited DVD-ROM will play for its rated time window and eventually expire. During its rated time window, the Time Limited DVD-ROM is compatible with all DVD playback devices including legacy devices. The Time Limited DVD-ROM is typically sensitive to temperature and some higher temperature devices may reduce the playtime of the disc if the disc is not removed from the device after use. After the Time Limited DVD-ROM has expired, it is possible to have no reflected signal from the disc and may cause a small number of legacy devices to not recognize the disc. With no reflectivity, the legacy device may continue to seek the disc. This may involve re-booting the operating system or restarting a device in order to eject the disc. For these reasons it is recommended to remove the Time Limited DVD-ROM from the playback device after use.
Therefore, Subscribers may wish to provide an appropriate notice to end users to avoid this potential problem. For this purpose, Subscribers may wish to consider the following sample caution notice to end users.

3. Sample caution notice.

As an example, the DVD Forum provides the following sample caution notice to be used for Time Limited DVD-ROM products and packaging for the above-specified purpose (hereinafter “the Sample Notice”)

Caution: Do not open disc package until ready to use Time Limited DVD. The Time Limited DVD will become unplayable after a predetermined time once the sealed package is opened*. Do not expose the disc too high temperatures or leave the disc in a playback device after playback. Once the Time Limited DVD has expired, do not attempt further playback, which may cause harm to playback devices or discs may be damaged.

4. The DVD Forum offers the foregoing Sample Notice only by way of example for Subscribers’ consideration and individual judgment. The DVD Forum does not require Subscribers to adopt the above Sample Notice for any Subscribers’ DVD products. It is Subscribers’ sole discretion and responsibility whether to use, modify or elect not to use the Sample Notice.

5. Subscribers are further advised that the physical characteristics of any such notice with respect to DVD Products, such as placement, type size and style, color, etc, shall be determined at the sole discretion and responsibility of Subscribers.

6. Subscribers may wish to consult their own legal counsel regarding the use or non-use of any such notice with respect to their products.

FURTHER, NEITHER THE DVD FORUM NOR ITS MEMBERS SHALL BE LIABLE TO SUBSCRIBERS FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF ANY CAUSE OF ACTION RELATING TO USE OR NON-USE OF THE SAMPLE NOTICE, OR BASED ON MAKING, USING, SELLING OR DISTRIBUTING ANY DVD PRODUCTS WITH OR WITHOUT THE SAMPLE NOTICE OR OTHER NOTIFICATION.
